Legal Director - Competition Compliance

Competition law is a key risk area for PepsiCo and this newly created UK role will take on responsibility for antitrust support, reporting to the VP Law UKISA and Competition CoE head. The role will have responsibility for supporting with competition law related issues, including driving competition compliance programmes and training, horizon scanning to identify upcoming risks and development and implementation of strategies to address, advising on customer engagements and incentives and playing a key role on the Competition CoE. In addition, role holder will support with review, drafting and negotiation of contractual agreements where antitrust issues are relevant in order to ensure compliance.
Will primarily be responsible for all antitrust issues governed by UK law, but given the increasingly global view taken by regulators and the UK’s leading position as an antitrust regulator, will collaborate with legal colleagues globally as required.
Responsibilities
- Development and roll out of competition compliance programmes, and updating of the same to ensure ongoing relevance to PepsiCo’s business and the broader risk agenda.
- Horizon scanning to identify upcoming risk areas (eg enforcement in an HR context) and development of strategies to manage and mitigate risk in relation to the same.
- Advice on customer promotions, incentives and contractual arrangements in order to ensure legal compliance and appropriate risk profiles.
- Support on strategic response in key risk areas (retail alliances, buying groups, territorial supply constraints).
- Support with contractual arrangements to ensure compliance (e.g exclusive supply arrangements with key suppliers).
- Key role in Competition CoE, with responsibility for developing and driving adoption of best practices.
Qualifications
- Fully qualified lawyer with a UK antitrust background and demonstrated expertise, and excellent academic background (2.1 or equivalent).
- 5 to 7 years of relevant legal experience at a leading law firm or corporate legal department.
- Superb communication and drafting skills in English.
- Proven track record of advising on and managing competition law risk, with pragmatic skills to balance legal risk against commercial priorities.
- Good knowledge of the FMCG and retail landscape, and emerging risks in relation to the same.
- Strong ability to identify, assess and mitigate risk, whilst enabling the business to move quickly.
- Effective time management skills and ability to meet deadlines, including ability to work under time constraints and multi-task.
- Highly organizedand proactive.
- Ability to translate legal requirements in a way that can be easily understood by the business.
- Ability to work as part of a collaborative team to deliver commercial objectives within acceptable legal parameters.
- Able to foster lasting relationships across varying organizational levels and among internal clients with the maturity to interface and persuade at all levels.
- Ability to collaborate effectively with legal colleagues and internal clients in a global environment.
- High level of commercial awareness.
