As our team and the programme we manage grows and evolves, this Group Legal Counsel or Compliance Manager - International Trade Controls (ITC) role is an exciting opportunity to play a crucial part in delivering on that purpose. In this role you will design, build and manage the ITC compliance programme and work with key partners in all areas of the business such as Product, Technology and Sky News. You will plan Group-wide classification requirements and compliance projects, identify risks, ensuring that industry best practices are implemented and communicate goals to relevant partners.
What You'll Do:

  • Report into the Group Counsel for Ethics & Compliance, supporting both Group and local Compliance teams in all Sky territories, as well as working closely with key partners;
  • Design, build and manage the ITC compliance programme by helping the business and other legal teams to identify solutions and to implement controls which mitigate legal risk for Sky whilst maintaining commercial flexibility;
  • Provide advice and guidance on U.K. (e.g., Sanctions Act 2018), EU (e.g., Dual-Use Regulation) as well as U.S. (e.g., ITAR, EAR) laws and regulations relevant to ITC;
  • Monitor upcoming developments, and assist in delivering legal updates, specific training and know-how updates relevant to ITC as required;
  • Support in the development, maintenance and revision of ITC policies to ensure they remain fit for purpose and coherent;
  • Provide and support on ITC in person training;
  • Support the Operational Compliance team to set up processes and perform ITC risk assessments
  • Develop effective dashboards and records and define relevant critical metrics together with the Sky's data analysts;
  • Partner with Comcast and NBCU compliance managers on enterprise-wide ITC initiatives.
What You'll Bring:
  • Bachelor's degree and/or equivalent practical experience;
  • Strong understanding of and experience in operating an effective ITC compliance programme;
  • Willingness to investigate legal and operational issues and distilling advice, practical outcomes and emerging trends for the business to assess and address;
  • Ability to operate in a fast-paced commercial environment demonstrating flexibility/adaptability to manage a workload comprising multiple wide-ranging matters and conflicting deadlines;
  • Excellent influencing, interpersonal and communication (written and verbal) skills, with an ability to adapt communication style to a variety of partners across the business.

GENERAL SUMMARY

The Trade Compliance Specialist will report directly to the Global Trade Compliance Manager and will perform a variety of duties necessary to support the company’s global trade compliance program. PRINCIPLE DUTIES AND RESPONSIBILITIES

  • Provide all round global export/import compliance advice to the business.
  • Develop, review, and update company export and import compliance policies, manuals and operating procedures.
  • Conduct periodic training of company personnel with regard to export and import laws, regulations, policies and procedures.
  • Assist the Global Trade Compliance Manager to develop and implement auditing methodology and conduct periodic audits to test company compliance with export and import regulations and Company procedures.
  • Identify and classify Export (ECCN) and Import (HTS, HS) classifications for the company’s products.
  • Ensure compliance with UK, U.S. and other applicable Export Control regulations, as well as conformance with internal corporate policies and procedures.
  • Export controls and license determination for all exports and re-exports of tangible and intangible goods.
  • UK Export Licensing: Submission and management of export license applications to the UK Department for International Trade Export Control Joint Unit via SPIRE.
  • Monitor and maintain trade compliance data elements in the company’s systems.
  • Support periodic internal assessments on the trade compliance program. Identify risk areas and recommend improvements.

KNOWLEDGE, SKILLS AND ABILITIES

  • Proven track record of meeting commitments with the highest standards of ethics and integrity.
  • Expertise with U.S., European and UK export and import regulations, including EAR, OFAC, ITAR and CBP.
  • Ability to gain knowledge and understanding of other non-US/Europe/UK trade regulations.

Primary Purpose of Job

Key tasks and accountabilities

People Management Responsibility

• Day to day responsibility for managing internal stakeholders within the Domain(s)/BGU(s) that the TC Team is responsible for. Some interaction with external stakeholders.

General

• Advise the relevant key stakeholders on the trade compliance requirements for imports and exports
• Contribute as a key user to the implementation of the local Trade Compliance policies, processes & tools • Support awareness and training sessions

Day-to-day activities, includes but are not limited to:

Technical & Professional Skills
Essential

Copello are working with a defence client who are looking for an International Trade Compliance Manager to lead the function ensuring Company compliance with international trade compliance laws and regulations, including UK, EU and US (EAR/ITAR).

Duties

•Lead the ITC team to provide licencing, authorisation support, guidance, and training as required for the ongoing prospects of the business, driving accountability and ownership where required within the team and within the Company

•Lead initiatives related to the development, automation, and continuous improvement of ITC processes and tools impacting all employees

•Provide guidance and authorisation strategy concerning the requirements, interpretation, and obligations of US export/re-export regulations and the implementation of such requirements

•Provide people and subject matter leadership within the business and Senior Leadership Team by creating an environment that accelerates development of ITC competency and talent

•Establish relationships with key internal and external stakeholders, including Inside Sales, Engineering, Commercial, Supply Chain and Projects

•Responsible for the evaluation of technology, hardware, and software (including classification and interpretation of UKML, Dual-Use, USML, EAR, ITAR) to identify ITC requirements and ensure appropriate authorisations and controls for exports and imports are in place

Primary Purpose of Job

A member of the Trade Compliance (TC) Team, reporting to the Head of Trade Compliance, and responsible for ensuring that the Domain(s)/GBU(s)’ s objectives are met in compliance with international trade control laws, regulations and policies, in particular those related to UK and US export controls and UK Customs.

Key tasks and accountabilities

People Management Responsibility

• Day to day responsibility for managing internal stakeholders within the Domain(s)/BGU(s) that the TC Team is responsible for. Some interaction with external stakeholders.

General

• Advise the relevant key stakeholders on the trade compliance requirements for imports and exports
• Contribute as a key user to the implementation of the local Trade Compliance policies, processes & tools • Support awareness and training sessions

Day-to-day activities, includes but are not limited to:

• Review or create and where necessary approve, all trade compliance documentation/requests e.g.: CECCs, ICECCs, End User Statements, DSP5s and other supplier licenses, TAAs, MLAs Sales Order/Contracts and Purchase Orders/Subcontracts/Purchase Agreements, Commercial Invoices, Instructions for Freight Forwarders/ Customs Brokers, MSS Data Report, to establish trade compliance requirements and to ensure all relevant information has been included
• Apply for UK export approvals, ensuring that End User Statements, F680 approval etc. are in place • Apply for US EAR licenses, using SNAP-R and liaise with our US to apply for appropriate DDTC approvals • Liaise with our internal functions to ensure US export legislation is implemented correctly, including guidance for Technology Control Plans, US export approvals, re-transfer authorisations etc. • Undertake appropriate checks for ITAR material (US suppliers) and DSP’s • Manage the return of any temporary imports to meet international customs & licensing requirements • Manage customs authorisations and renewals • Secure export controls with record keeping and reporting

Technical & Professional Skills
Essential

• A reasonable knowledge and experience with the UK and US export regulations (ITAR and EAR) and the UK customs regulations

Preferred

• Experience of working in defence and/or dual-use sectors
• Some EU Export Controls knowledge

Education & Qualifications

• Associated degree preferred (e.g. law/international business/engineering)
• Minimum of 1 to 3 years import / export controls experience

Personality / Behaviours

• Can work independently, with some supervision from time to time
• A “can do” attitude • Good commercial awareness • Effective time management skills • Excellent attention to detail

• Should have a strong sense of integrity

Recognising the restricted nature of the work  there is a requirement for the candidate to be eligible to obtain Security Clearance for this role.
